Acceptance of Terms

By visiting, browsing, or otherwise using any service operated by vivahand Store, you confirm that you have read, understood, and agreed to be bound by these Terms of Service together with all federal, state, and local laws and regulations that apply to you. Should you disagree with any portion of these Terms, you must refrain from using vivahand Store's services entirely. Anyone who accesses our services on behalf of a company or other legal entity affirms that they hold the authority to bind that entity to these Terms.

Use of the Website

You may use vivahand Store's services solely for lawful, personal, non-commercial purposes, unless vivahand Store has granted you written authorization to do otherwise. The following activities are prohibited:

• Breaching any applicable law or regulation, including consumer protection statutes and product safety requirements
• Sending unsolicited advertising, promotional content, or spam through our platform
• Seeking unauthorized entry to our systems, customer accounts, or inventory databases
• Misrepresenting your identity or posing as any person or entity, including vivahand Store personnel or fellow customers
• Deploying automated tools, scrapers, or bots to harvest product pricing, inventory data, or user information from our platform
• Submitting fraudulent, excessive, or malicious orders, including orders placed without any genuine intent to receive the goods
• Reselling vivahand Store products for commercial profit without our explicit written consent

Product Information and Pricing

vivahand Store works diligently to keep product descriptions, prices, specifications, and availability details accurate and current. If an error affects product information, pricing, or availability, vivahand Store may correct that error and cancel any order placed on the basis of the incorrect information, at no cost to you. For goods with natural variability — such as handmade items or products made from natural materials — minor differences in dimensions, weight, or appearance compared with the listed specifications may occur. Product details and warnings are supplied for reference only; vivahand Store cannot guarantee that products are entirely free from cross-contamination during processing or packaging. Product availability may differ depending on your delivery zone, chosen pickup location, and selected time slot.

Orders and Payment

Every order remains subject to product availability and acceptance by vivahand Store. vivahand Store may decline or cancel any order at its sole discretion, including orders that appear fraudulent, breach these Terms, or cannot be fulfilled because of stock shortages. Full payment is required before an order is dispatched or made available for pickup, unless vivahand Store agrees otherwise in writing. Minimum order values and delivery fees may apply depending on your selected delivery zone and time slot. Where age-restricted products are involved (including alcohol, tobacco, and vaping products where legally permitted), you must meet the legal age requirement for purchasing such items in your jurisdiction, and a valid government-issued ID will be required at delivery or pickup. Should an item in your order be out of stock, vivahand Store will notify you before dispatch and may propose a suitable substitute or refund the unavailable item, unless you have opted out of substitutions at checkout.

Intellectual Property

All content made available on vivahand Store's platforms — including text, images, logos, software, private label product packaging, and the "vivahand Store" name and branding — belongs exclusively to vivahand Store and is safeguarded by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any vivahand Store content without our explicit written consent. User-generated content (including product reviews, photos, and comments) that you submit to our platforms may be used by vivahand Store for marketing, promotional, or operational purposes, in accordance with our Privacy Policy.

User Responsibilities

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must promptly inform vivahand Store of any unauthorized use of your account or any other security breach. You are likewise responsible for supplying accurate, current contact, delivery, and payment information when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you submit are truthful and complete. If you place an order on behalf of a third party, you alone are responsible for confirming that the third party satisfies all legal eligibility requirements for the purchased products, including age restrictions for restricted goods.

Limitation of Liability

To the maximum extent permitted by law, vivahand Store shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our website, products, or services, including but not limited to damages for incidental loss or delivery delays. Our total aggregate liability to you for any claim arising from a single transaction shall not exceed the total amount you paid for the products or services in question. vivahand Store is not responsible for service failures or delays caused by circumstances beyond our reasonable control, including but not limited to supply chain disruptions, severe weather, public health emergencies, or third-party carrier delays.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of vivahand Store's services shall first be submitted to vivahand Store's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

vivahand Store may update, modify, or replace any portion of these Terms at any time at its sole discretion. If material changes are made to these Terms, vivahand Store will provide at least 30 days' advance notice by email to the address associated with your account, or through a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using vivahand Store's services prior to the effective date of the changes.
